It is a serious question. Obviously you wouldn't. But if it were a $250,000 Challenger, with a duplicate listing for $350 grand, and you won the $250,000 auction, you would want to look into choice of law and choice of forum.

You can sue in your state, and get a judgment, but then you have to get it certified in the seller's state, and enforce your judgment there. You might be able to sue in federal court if seller and buyer are from different states.

For small stuff, you can get some sort of personal satisfaction out of a small claims court. No lawyer required. I got a judgment against a New York corporation, but New York doesn't recognize California small claims courts. Victory?

It is all theoretical. If the guy only has one gondola kit, then I award him status on the IQ scale to move the average leftward toward 99 - either that, or if he is aware, then I award him jerk status. Other than that, I have enough Lobaugh gons, thanks.

We've been having a lot of fun with this one. :mrgreen: My suggestion of Judge Judy, was a sideways bit of sarcasm that subtly inferred small claims court would be the way to go, if you were silly enough to pursue it. Things get sticky when it goes beyond state borders, and when you are paying a lawyer, the expected reward better be enough to warrant the legal fees, or you can both win and lose.

This really should be a matter for Ebay to police. (opinion)

Rufus, I yield....your choice of judges is superior to mine....hang 'em high!

As for Professor Kingsfield, he was a fictional character that taught Contract Law at Harvard Law School in a novel, film, and TV series. The Novel was by John Jay Osborn, The late John Houseman won a Best Supporting Actor Academy Award for his portrayal of the professor, and then reprised his role in the television series.

Case closed.

Now I remember. Our Contracts professor told us to watch that movie. It apparently didn't leave a lasting impression. I never watched Judge Judy, but now and then I see snippets of Janine Pirro. I quick hit the mute button.

That judge lady moved next door to a customer of mine. Ms. judge is not a nice person in real life. On a side note eBay bids on autos and real estate are none binding. Auto sales are filled with fraud on eBay.

Apart from Houseman's performance, it was (again opinion) nothing special. More about the students relationship with Kingsfield's daughter who he gets involved with before knowing the Professor is her father. I am guessing the novel was more entertaining. Seems to me I read it, but it's been too long ago. I do recall that Kingsfield is oblivious of the relationship between Hart (the student) and his daughter. If the Kingsfield character had not been present, NO ONE woulld remember the film. Not that the other actors were bad, just not all that much of a plot!

"Personal experience?" Yes. 2 of my antique motorcycles were photographed during a public show. After the show the were posted online with a comment" I see rob brought out 2 of his bikes". Harmless at the time. Just a friend posting photos on the antique motorcycle club of america's website. Then sometime later another friend calls me to say " You promised to give me first shot at one of your bikes. Why did you place it on eBay for sale?" I told him "i not selling my bikes" He sent me a link showing them for sale. Somebody had copy and pasted the photos to eBay. Harmless to me. a few people had bid. I sent an email to eBay and with in an hour they had pulled the sale. A lot of things like this happen on a sale site called Odelle's.
A quick google search shows eBay does not consider auto and real estate bids binding. With a short answer of state laws very to much.

So was an unknown selling them or was your account hacked and they were placed there to be sold by someone using your account? I have had the latter happen to me; I cancelled the listing, changed my passwords on every account everywhere, and then notified eBay.

A lot of things like this happen on a sale site called Odelle's.

This happens all the time on evil bait.
We get so many reports of such on the car sites they need to have a special forum, it seems.

Somebody takes photos of your vehicle, innocently posts them, some scammer snags them, offers said vehicle for sale cheap, and it's off to the races.

Reports are often evilbait could care less, and even with a dozen complaints never pull the offering.

No hacking of you account, or e-mail, just snag the photo off the internet and go from there.

But you know, there are so many folks who support evilbait no mater what, it's really funny when this stuff comes out....and equipped with blinders.

Except my account actually was hacked and there was Harley that I did not own under my for sale listings. Ever since then I take a look to see what I might be selling that I did not list.

My bike was for sale on someone else's account. I had two hacked purchases on my account. Paypal gave me a refund of the monies spent. With real estate sales. I don't know all the details.
